View Full Version : Two co-tenants on a lease, one is not paying rent. How do I get her out? California

PLEASE HELP!!

I live in an apartment in Roseville, California (Placer County).

I am on the lease along with one other room mate (until March 31st, 2007), therefore making us co-tenants....right?

She lost her job and has become "the room mate from hell".

She was not able to pay the January rent so I paid it for her so that I would not get evicted. We verbally agreed that I would give her the chance to pay me back.

She has yet to pay me back and now has not paid her share of the February rent. I paid the rent again today because we got a "3-day Pay or Quit" from the apartment office.

I am on very good terms with the apartment manager and her office staff. They know that my room mate is the one f-ing all this up.

I have read that because we are co-tenants, I have no legal right to "throw her out".

But thats as far as it goes....no one gives an actual suggestion on how to get her out!

I DO NOT WANT TO PAY HER RENT ANYMORE!!

Do I just have to take her to court or what?

The easiest way is also the one most expensive for you.

Pay the rent for February and March, move out, and then take your roommate to small claims court for his/her part of the rent.

Get a letter from the apartment complex saying that you are the sole payee on the lease.

Anything else would require you to start eviction proceedings, and your lease will be over before that happens.
