View Full Version : Tenant has moved, not pd utilities South Carolina

Our tenant signed a 3 mo. lease, which stated she had to change the utility accounts over to her name, and pay them separate from the rent. She changed the electric, but not the gas or water accounts. She paid the electric and gas, but never paid the water bill, although she told me she did. (I have paid it because I don't want the water turned off, nor do I want a "black mark" on my account as the account is still in my name.) After 6 wks., she moved out. I found out she moved only because I called her the day she was moving and she blurted it out, figuring I had seen the moving truck. She has paid the second month's rent, which brings her up to Feb. 19. I am unable to contact her by phone since she doesn't return my phone calls. I know where she moved to, although she doesn't know that I know. She thinks she just left me high and dry. My question is threefold: 1. If she does not pay the 3rd month's rent, how long do I have to wait before change the locks, 2. before I take her to small claims court for payment of the rent and utilities, and 3. since she did not do what was stated in the rental agreement, i.e., change over the utilities to her name and pay the bills, is she in default of the rental agreement? I do have one month's rent as security, but she has done some damage to the house and I may need it for repairs. If anyone knows the answer to this I would appreciate knowing.
