My girlfriend and I signed a one year lease and moved in in December. We paid Januarys rent on time. On the 12th of January we notified him we would have to break the lease. We helped him find a new tenant who gave him a deposit and took posession on the 26th of January. There were no damages to the property and the landlord encurred no damages. The lease has no provision for early termination, except that the reamining months rent be paid in full.

And now for the question. Are we entilted to our deposit back? Every thing I read leads me to the conclusion that we are. I believe since the property rented the day we vacated, and there were no repairs, or outstanding bills, the landlord was not damaged and that is the purpose for a deposit of security.

Does anyone have any ideas on this??
