I have been out of work for 3 weeks, first week i was home with my kids sick, second week i was home because the kids got me sick now the thrid week because Super Bowl Sunday I pulled my back out and dropped to the floor in pain. This is my third week out and was in the E.R and got a MRI yesterday for diagnosis. I have dr's notes for the second week out and this week. HR at my work is filing for short term disbility for me. My back is starting to fele better which means, it was a spasm and i'll be fine but since im moving soon I figured I could stay on disability or get fired and collect unemplyment. We have 2 small kids and currently paying over $1,000 a month in daycare, I could stay home with them and pocket all that money. At this point I don't think they will fire me unless I do no call no shows a few days but I don't think I would be eligable for unemployment then. So any suggestions on getting around this?

Obviously not injured enough to continue to legitimately qualify for disability. Nice try, though.
And you don't get unemployment unless you are able to work, actively looking for work and able to accept work if offered. You don't get unemployment to stay home with the kids.
rcpilot 02-08-2007, 10:51 PM You won't qualify for unimployment if you are unable to work. You cannot stay on disability without a Doctor, who is approved by the WC carrier, stating in writing that you are unable to work.
If your doctor says you can work light duty and you are offered light duty which your employer can offer you, at near your old wage, you must accept the light duty job, which in turn will reduce your WC to the average between what they are paying you now and your new pay.
If you are able to work, and get fired with cause, you will not collect Unemployment Insurance payments.
If you are fired for no stated reason, you must actively seek employment to qualify for UI and btw UI doesn't begin till you have been off work for two full weeks.
Best advice, quit and spend time with your kids while you can, suck it up, and relieve your employer of a, if not dishonest, very dishonorable employee.

2kidsrenough4us 02-16-2007, 12:06 PM First thing, I never said anything about workmans comp, someone else did. My MRI showed two disc hurniation in the lumbar spine. I am seeing a orthopedic surgeon for further care. I am going to be on short term dissability in which, i pay every week out of paycheck so i'm not a fraud. I have films and a report to proove my injury. I understand why everyone thought I was trying to commit fraud, because people do everyday I guess I worded my situation wrong and made people think I was trying to steal or something.

ElleMD 02-16-2007, 02:57 PM If you were legitimately unable to work and covered by a STD policy, why did you write us? You'd be covered under the policy regardless of what you choose to do about day care. Bear in mind though that if you are able to care for young children (have no idea how old yours are) you may not meet the definition of disabled under the policy. Having a medical condition does not mean you can not work and are eligible for STD.
