Can someone please give me some advice? I have been in a lease agreement in AZ for 2 full years. Last year, the landlord was very relaxed about giving us a new lease... she waited 5 months before even giving it to us (but it was dated as though we were signing it in January, when it was actually May).
This year, my job will almost certainly be ending. I am funded by a federal grant through the University of Arizona. I am unsure yet if my position will extend past April. I told my landlord this, because we have always had an honest relationship. I asked if we could handle rent on a monthly basis, and expected no problem based on our previous experiences. She said absolutely no, and tells me that my wife and I have 60 days to leave. This is unexpected and a huge burden upon us, as I am already facing tremendous uncertainty in employment... and in a tenancy that has completed 2 satisfactory years of leases. There is one catch to that last sentence... I was charged some late fees for paying rent late in November, and I have not yet been able to pay them.
Does my landlord have the right to force us out for not signing another 1-year lease, if we have already been residents through 2 years? With the exception of the one month where we had to be late, and the still-outstanding late fee, we have never even stretched the terms of our agreement, and we have kept the house in great shape.
A final thing to note is that my landlord has already accepted rent for the month of February, despite the lease having expired in January, and a new one has not even been presented to us... does this give me any rights to claim that a tacit month-to-month agreement was already made (especially after my experience of last year)?
