Hello Everyone,

Me and my Husband moved in into an Apartment in Newark, DE on July 1, 2006 with a lease period of 1 year (Lease ends on June 30, 2007). My husband got transfered to Ohio and we gave lease termination notice to the Leasing Office on Jan 30th and my Husbands employer faxed a letter mentioning the Job transfer to Ohio.

Deware Tenant Code says, the 30 day notice starts from the 1st of the following month from the lease termination date, which is Feb 1, 2007. This Apartments Manager says, since Feb has 28 days, the 30 day notice ends on Mar 2nd and that we have to pay rent for Mar 1st and Mar 2nd. This is not the issue. She is enforcing us to pay the Renovation Charges, amount of 1month rent.

We can break the lease by giving the 30 day notice since we are moving out of the state (not in the 30 miles diameter) on job tranfer , which is legal and which is mentioned in the Tenant Code.

What is this Renovation Charges mean? There is no such a thing in the Tenant Code. Is there any law code which says we have pay the Renovation Charges upon termination of Apartment Lease?

What happens if we deny to pay the Renovation Charges?
