I have recently put in my notice of 2 1/2 weeks at my employer. My contract letter that I signed when accepting the position states...."Contrary to PHNS' vacation policy we allow you to take 40 additional hours of unpaid vacation during your first year of employment and you will receive a bonus in the amount of 40-hours regular base pay less applicable taxes. This payment will be made at the time you take your unpaid vacation and must be coordinated through PHNS payroll department. "

I have been approved to take that 40 hours off but now will be leaving before I take the time. Am I entitled to that 40 hours of bonus vacation pay?

Not unless you have a binding contract that guarantees you will recieve it no matter what.

As we told you in your last post, Michigan does not require the payout of fringe benefits unless they are explicitly promised.

What defines a binding contract? This is my contract stating my pay, insurance, etc when I was hired.

What about bnous float time given to you for a job well done?

Does your contract specifically say, Any unused time will be paid out at termination?

If not, Michigan law will not require them to do so.
