Hi - I was out sick for four days last week. Im non salaried, non exempt hourly employee in MASS. Payroll forgot to pay me for my sick time and I am paid every two weeks they are making me wait until the next pay period 2 weeks from now. Its the end of the month and I have bills due - is that legal -arent they supposed to cut me a check?

As a non-salaried, non-exempt employee you have no legal expectation of being paid when you do not work. It's a shame that you have to wait for your sick pay but since they don't have to provide it at all, it is not a violation of any law to delay the payment.

And the "devil in the details" here is that sick pay is not wages for working; hence the legal difference.
Now, I've been a Payroll Manager (plus) for many years now, and this is, in my opinion, terrible customer service. Unfortunately, bad customer service does not necessarily mean illegal.
