I gave my two weeks notice and after two days fell sick with the intestinal virus and had to call in sick one day. My supervisor informed me that it is company policy to enforce a makeup day at the end of my notice. I am unable to comply with this obviously I am starting a new job. I told her I would get back to her with an answer. She said I am legally obligated in MA to do so. Is this true? What are the consequences?

There is no law in MA or any other state requiring that. There may be a company policy that sick time is not paid during a notice period; that would be legal. Under the concept of "at-will" employment, they cannot make you stay longer than you choose to.

Thank you thats what I thought. But justthe same I'll wait to tell themI'm not going to do it until the day before.

Just curious. What are the consequences if you don't "make up" the day?

I honestly don't know I think they would just accept my resignation immediately. Either way they are going to make it look like I left on bad terms.

Any advice on how to break it to them? That is how to say tactfully I'm not going to be extending the notice?

I'm sorry, I cannot work past my original resignation date?
