This is something of a follow-up to my last post in regards to late paychecks.
Today I will be receiving a paycheck for period 1/15/07, which legally should have been to me on the 21st (so it is 8 days late). I also had a paycheck in December that was given to me in two parts, one which was a day late, and the other "installment" was 7 days late. There is some question as to whether the payrolls for February will be on time, as well - there has been a decision made that the paycheck for period ending 1/31/07 will not be given out until 2/15, and the check for period ending 2/15 will not be given out until 2/28. I don't have that last part in writing, and now that I've made it very clear that I won't, as the payroll person, run these payrolls unless they are timely, they're back-pedaling, saying they're still trying to get the money together.
My question is: can I, with the two paychecks given to me late, claim non-compliance of the employment laws and have a good chance of receiving unemployment benefits if I resign my position?
