View Full Version : On Call to Scheduled work Hours

OK - After reading through the lack of control and laws associated with "On Call" Status - it raises an interesting issue, and I think I have answered my question through extension but wanted to make sure.

I work a schduled time of 9 am to 3 pm Monday through Friday....we are on call a week at a time through a rotating Schedule.

If I understand this correctly, and the events transpired to create this, if I am on call and kept awake till 7 am, and sleep 6 hours - they are well within their rights to deny me my normal pay rate for the schduled hours I "missed" because of an emergency call that took 5 hours to bring a system back online.....this sound right?

I think the OP is saying that he did not make it in a 9 a.m. as scheduled because he had been called and was working until 7 a.m.

What do you mean, your "normal pay rate"? Unless you are an exempt employee (which I'm doubting, but don't know for sure, since you didn't post what you do), the employer only has to pay you for the hours you actually worked. If you came in past your scheduled report time, they don't have to pay you at all for the "missed" hours.

There is no law that requires you have XX number of hours break between work shifts (including call-back time) unless you are something like an interstate trucker, pilot, nurse (in some states), etc.

You're welcome, but I still don't know what "normal rate of pay" means, nor how it affects this situation. :confused:
