okay- first of all, you have sole custody of your daughter and until a court grants him visitation, you don't have to allow him to see her at all. He is right about the money though- anything he gives you without a child support order is considered a gift and you could go back and get support from him. The best thing for you to do is get a CSE rep, if you don't already. They will open a case for child support. At that point, he can either accept or deny paternity. If he denies, a judge will order a DNA test (he will have to pay for it if he turns out to be the dad). They will then begin garnishing his wages for the support. At this point, you still don't have to allow him to see the child. He will need to file for visitation in order for a judge to set visitation times/rules. Once those are in place, you cannot withold visitation, even if he's not paying support. They are 2 separate issues. They say he won't cooperate. Ask them to have him served with court papers to order child support. Once he signs for the papers showing him a court date, etc, if he doesn't show for court, the judge will order a default judgement against him granting you CS. You have to stay on top of CSE though. They have a lot of cases and the squeaky wheel gets the grease.
