View Full Version : Help with Custody Laws? Do I have reason to Worry? Nebraska

Hello Everyone, I just wanted to ask some questions My BF and I split in November, Things are civil Between us right now, but I am worried that if things do turn bad, are there things I should do to cover myself. He was not at the birth therefore, he was not there to sign the birth certificate, however when they gave me his generic birth not the certified one, I havent ordered his certified one yet, but certificate from the hospital it had his name on it. I just want to make sure he couldnt come and take our son, I dont think he would, but I want to be on the safe side, so can any of you help me out, on if there is something I should and can do to cover myself.

if his name is on the BC, he is the legal father. As you were not married, you have sole custody until such time as he decides to file against you. I would go file for sole custody and an order for child support. It will protect ALL parties involved. You can also work out a visitation agreement when you do all the others, or you can let him file that. If he does not file for visitation and you have sole custody, you are not obligated to let him see the child. It would be best, of course, for the child to have both parents.

The name on the birth certificate is not always an indication that he is the legal father yet. There would also need to be an affidavit of paternity signed by both of you. You could just file to establish paternity and custody and go for sole custody to be on the safe side for both of you.

You can not keep him out of the picture however... If he wishes to get visitation/custody now or in the future and he is by DNA the father, he will end up getting it unless he is declared to be an unfit parent.

We have not had a Paternity Test, but he doesnt deny he is the father, I just wanted to know if there are some things I should do to cover me and my son in case things do go bad, as of now things are civil between us and I will try my hardest to make sure it stays that way, and I wont by any means ever deny him from seeing his soon, I actually encourage him or try to get him to come see him, but he travels for a living, and puts money before his child, but anyhow, Any more suggestions are welcome!

Go to the local court house and ask for the paperwork for child custody. Also ask if a petition of paternity is required or if he could just sign and have notarized an affidavit of paternity. The filing fees aren't that much and you can do this on your own, it will be worth it to have everything in a legal document.
