My husband and his X decided at the time of their divorce that she would carry the health insurance ( because at the time, she had better coverage) and he would reimburse her for the amount. It states in their divorce decree that if "Dad" elects to provide health insurance coverage for the child, which is comparable to the insurance provided by "Mom", and if the parties agree in writing, then upon such written agreement, the "Dad" shall purchase, obtain and maintain health insurance coverage.
One problem with this is that "Mom" will never agree to the change. The "Mom" has been ordered to give all information concerning the health insurance coverage on the child, including documentation on the actual amount it cost to cover the healthy 8 year old child. ( is $280.00 to much for a child through a large school district policy??) We have requested in writing, by certified mail, this information and all she has given to us is a photocopy of the insurance card.
We asked his divorce attorney if he could cover his child on his policy and stop paying her the $280 a month plus child support. He said, stop. BUT in his divorce decree it states.... that "Dad" is to pay to "Mom", as additional child support, pay this amount every month for medical support of the child.
So, we didnt stop paying or cover his child on his policy, because to us, it sounds like the medical support payments are considered additional child support?

Sorry this is so long but just got another certified letter in the mail from "Mom" and had to get this off my chest.

he needs to send her another certified letter that in order to pay her the medical insurance support as stated in the divorce decree he will need something from her employee showing the monthly cost of the child's portion of the health insurance. If she does not supply, file a modification that dad would like to start carrying the health ins as he now has it available. A judge is not going to look favorably on her not supplying the info. 280 seems like quite a bit on that. my hubby pays 180 for our whole family in a comparably priced company. He could purchase and individual policy cheaper than that unless the child has a lot of preexisting conditions.

Thank you!! This is exactly what we thought. I have a feeling that we are also paying for HER health insurance and that is why she is not wanting to give us anything more than a verbal amount. He got in this mess to start with because he let her "have her way" and he agreed with it just to get it over with and not have to deal with her anymore. This all happend before he and I ever met and its like pulling teeth to get him to deal with her anymore. Yes, she's that controlling and hateful. I can never understand women like this. It should always be about the CHILD and nothing else. In her case...its $$. But right now, its what the law is and we have to go by that.

i seem to find that most men are like that and then us women come along and take care of it for them. I have to drag my hubby to meetings with his lawyer and CSE cause I am so tired of him letting everyone walk all over him
