I've been with the company less than 5 yrs. I'm allocated 160 hrs of vacation each year that is eared a portion each month - upon resignation my pay was docked much more than I thought appropriate - apparently there is a policy I didn't know...

The company policy reads....

If you are level X or higher with less than 5 years of service, you will only accrue and receive pay for up to 80 vacation hours if you terminate your employment with the Company before December 1st, except where prohibited by applicable law.

The question....How can I determine what law is applicable in GA? Can you recommend an employment lawyer?

In GA, it is not required that you be paid ANY vacation time at termination.

There are states, and I'm betting that your company has offices in some of them (thus the statement about applicable law) where ALL accrued vacation time must by law be paid out at termination. I'm in one of them. No matter what the circumstances, even if we catch an employee in the act with his hand in the cash drawer and several thousand dollars in cash in his pockets, we have to pay out any and all accrued vacation time when we fire his ***.

In GA that is not the case. Legally, in GA they don't have to pay out vacation time at all. If you received ANY vacation time, it's more than the law requires. So the only question is, did you receive what the policy requires. Sounds to me if you received up to 80 hours, the company is in the clear. Did you?
