View Full Version : Can employer deduct for advanced vacation Washington

I work in WA state and am about to give notice to move to a better job. but a co-worker recently told me that my employer will deduct from my final paycheck any vacation or personal time used. I have no written or verbal agreement on this, so can they deduct the money. I have missed 4 days due to pneumonia which i have been paid for. Also does the law differ on personal time, vacation time, and a floating paid holiday??

When i was hired i was told i would be given 2 weeks vacation each year, 1 week personal time, plus a single floating holiday, starting Jan 1 each year. (i was hired dec 12, and just started my 3rd year). i was never told the time was "loaned" to me untill the end of the year. and from looking at the WA state L&I site, vacation is a benefit given by an emplyer, not necessarly earned like some states. And shouldnt i be told this up front?

Just because it is a "benefit" doesn't mean it has to be vested up front; it can still be "earned" as the work is performed and, honestly, it would be a very rare policy that did not require it be done that way, whether it was communicated to the employees or not.
