Does my employer have to give me my bonus check for the past year? He is giving the bonus checks out on Friday and I gave my resignation this week earlier.
Is he required to still give me the bonus check that was actually supposed to be given to us before I gave my resignation? Am I entitled to this bonus check already printed and signed since I am still an employee there for another week, or another way put, is the employer obligated to give me the check since it is for last years reward for work done in the past year?

What does the bonus plan say about this?

Since this is a cash bonus plan and almost certainly is not a "qualified" plan (i.e. subject to federal ERISA regulations that govern benefit plans) it is extremely likely that the employer can award and withhold bonuses as they please.

But if its definitely determined and has become due and payable to such employee, then its a wage, in which case the employee must get it.

I agree with you Beth for those types of plans, but I think Pattymd's question is the place to begin with the analysis. This poster hasn't given us enough info to know what she's got.
