I am supposed to move into a house in Indiana but the woman there has not moved out yet (the move-in date on my lease was January 2). She gave written 30 day notice to the landlord which is up.

He told me that because he has her notice in writing that he doesn't have to go through regular eviction procedures. Does anyone know if this is true? All the states I've lived in you had to go to court to evict someone.

I've searched for info on this but can't find anything.

What he means is that she will have to move like it or not. In many states the landlord can evict the tenant and be granted holdover fees which can be as much as twice the rent.
Under certain conditions, you too may sue the tenant for damages such as hotel stays due to having no place to go.

But he still has to take her to court to get her out, right? From all I've read, you can't change the locks and take someone's stuff out without a 3-day notice from the Sheriff that has expired.
