View Full Version : Harrassing the HR Rep Massachusetts

I don't even know where to start...I am employed as a Senior HR rep, recently promoted to the position actually. What a major mistake I made. I was originally working as the payroll/hr person and having a difficult time of it. I had 2 supervisors who can not stand each other and used me in the middle. However out of the 2 the HR supervisor seemed a little easier to tolorate.
My payroll supervisor decided one day that it was approprite for him to yell at me to "get the f#%k out of my office" and of course loud enough for all to hear. This was reported to the President of the hospital who assured me that this was not the first time this person has done this and that he will be repriminded, a letter placed in his personnel file stating that he will be terminated should something like this happen again. Well, I guess you all know how it ended. The CFO, who is his supervisor decided that was not necessary and he was scolded acted contrite for a few weeks and is back at it again. I took the promotion because I did not want to deal with him. Nice try but no.
My HR supervisor went on vacation and he decided that he could again yell at me in the hallway where peers could hear and I could do nothing but stand there like an idiot and take it. (Oh, by the way have I mentioned I am a 5'6" 120lb Female and he is 6'4" weighing in at around 215lbs). I informed my supervisor and a meeting took place where he informed the President, CFO, and HR Manager that I was taking things personally and that any inapproprite language was used by me. I was not invited to attend the meeting. I was informed this past Wednesday that I am not to have any direct contact with him, anything that needs to be done will be sent to my supervisor and she will forward the info. I am informed today that , "ahh NO, this is creating too much work for me and you'll have to deal with him directly." I told her that as the HR manager I was shocked at her response and that it was unacceptable. At that point she hangs up the phone comes thumping and banging down the hall, ( She's 5'9" around 160lb conservatively) slams the door to my office bends over my desk in my face (I had to push my chair back) and informs me that I am "ungrateful" and that she has scheduled a meeting with the President and I am "being selfish thinking only of myself " and she had "only been back for 3 days and look what you've done to me".
Wow...Fun huh?? Who wants to be me right now??
Okay, really long summary ended and here is my question. I clearly get that I am being harrassed and that the environment is hostile. I also clearly understand that they will cover their own asses no matter what. I see no point in a meeting w/ the president because nothing happend in the past why go there again? Basically, I want to try to find a way to get through day by day until I find something else. How can I do that?? Do I have any rights at all in regards to giving notice? For instance if I give a 1 month notice can I be let go right away? The hospital is "employment at will". Does anyone have any suggestion as to how I can deal with the situation? I really do not want to have the meeting with the President which is suppose to take place this Monday. I assume that my HR manager will be right there beside me to twist everything to suite her purposes. HELP

Document, document, document.

Write down what you told us in a manner that clearly shows the paths you took to resolve this problem. It sounds like you are in the right.

My wife works for the CEO of a large health care facility, with over 2K employees. situations such as this are delt with harshly. They tend to cause expensive setlements.

As someone in the HR department, you should know this. ;)

As an HR rep, you should know what constitutes a hostile work environment.

It is NOT caused by someone yelling at you or using vulgarities.

An HWE exists ONLY when you are being subjected to either sexual harassment or illegal discrimination under Title VII and related laws (race, religion, etc.)

Do I think upper managment should deal with this? Of course I do. Are any laws being violated if they do not? Not based on what you've posted.

You also should know, as an HR Rep, that if you give notice you CAN, legally, be asked to leave immediately. You would most likely be eligible for unemployment for the unworked notice period.

Thank you all very much for your responses. Yes I know that as an HR rep I should be able to handle this situation easier than a regular employee. Unfortunately, my position has just made it more difficult to deal with it.
The situation was discussed and addressed by the President of the hospital months ago and as I mentioned the CFO decided that the President's response was too harsh and that speaking with the Controller would be enough. As I mentioned it was not.
I know that I can be terminated as soon as I mention giving notice, I was just hoping that someone had some experience with this and found a way to make it work.
As for Harrassment. My understanding of Hostile Work environment is "any behavior that is perverse enough to affect your work performance". So I do understand that it is Hostile. Unfortunately, it is just somewhat frightening for me to have it be Executive Managers, who should know better.
I have been looking for a new position. Sadly it seems easier for me to look for something new than it will be to try and get this mess straight.
