my daughter was born September 12 2005 and passed away November 18, 2005. She was only two months and six days old!!! My daughter ended up getting a cough so like all first time moms I took her straight to the doctors. her doctor said that she was too small to give meds to so to use a humidifier and it should clear up. Well the next week it was clearing up it was actually worse. so I took her back, the walk in doctor said to keep using the humidifier and to give her infants Tylenol. so I went a head and did that. Well her cough was getting even worse so bad that to she was turning red trying to get the cough out. So I took her back again. This time a male walking in doctor saw her and I was having a fit so he sent me to get a chest xray on her, which when I got there the other people that were seeing doctors that day were getting chest x-rays too its like they were just sending everyone there. Anyways, I went back to the walk in doctor after and he said that the test came back neg, to keep giving her the medicine. so the week after that it was her two month check up so I was happy that I would get to talk to her pedi. and ask her what’s going on myself, so I had went, well her pedi wanted to give my daughter her two month shots..I stopped her and told her "I thought that you cant give her shots even with the slightest anything" her pedi said it was ok because her chest xray came back neg. so again like all first time/ single moms I believed the doctor. during these weeks of her being sick I called her doctor every few days and her eating habits didn’t change and neither did her smiling face. she was always happy laughing and cooing. any how, with in a week of her getting shots is when she passed. on November 18 2005 my daughter woke up and eat like she always did. she was still smiling of course. we had to go do some stuff that day so I made sure I dressed her warm well at the store about 3 pm she broke out in a sweat...I took her temp with her thermometer I had in her bag and it was only slightly above normal. so I called her doctors office and the front desk said that they would get ahold of her doctor and call me back so I then gave them my cell number. well I didn’t hear anything so I called back they said they were waiting and I told them I could go in and they said no that it was ok that they would get her. well about 5:30pm I got home and I saw the machine blinking and it was the doctors office telling me to give her infants Motrin too and if her temp got worse to take her to emergency. so I left her with my father and went to get the medicine and pizza and by the time I got back my dad was in tears he said to get her to emergency now that she was having convulsions. I took her temp it was 105.9 in disbelief I took it again it went from that too 104.3 103.9 so I gave her some Motrin and took her to emergency. When I got there they took her temp and gave her meds up her butt. They gave her a bed as soon as she went in. They started breathing treatment immediately for her congestion. They were trying to get IVS in here but every time they got a vein it went flat. The tried to get the iv all over her body but no luck. The tried to do an io which is a needle that they put through to the bone and twist in. You can actually hear it pop, but that failed as well. They were going to air lift her to a specialists so they had me go tell my family they would have to drive by the time I went back into emergency they had moved her. The nurse had me sit and wait for like 30 min and finally someone came to talk to me. They said she was very sick and wouldn’t make for they had already brought her back twice. He finally took me to her bed and I found two doctors working on her with a staff of 15 people, one of the doctors was the specialist they air lifted him to her. They tried everything to save her, they even cut her leg open to get to the vein and that still failed. They could make her hold on anymore and god called my little angel back home. Later that night they said that she tested positive for RSV. It’s a respitory virus. They said her pedi could of detected by swabbing the throat or nose and had her treated for it in the hospital. It makes me mad because at her pedis office in every exam room there was a poster about RSV and I even asked her doctor about it and she said no that wasn’t it. Is there anything that I can do legally? I just recently got her death certificate and it says they cant determine cause of death. It could of been RSV that took or it could of been her shots or both. Please help me!!!!!!!!!!!!!

I am so sorry to hear of the loss of your precious daughter.

If you think that malpractice contributed to your daughter's death, you should consult an attorney who specializes in this field. Be aware that the statute of limitations may have already passed by now - I think it is only one year.
