The company I work for has a no smoking policy, but does not enforce it.
It has come to my attention that the Co. is paying insurance premiums that reflect a nonsmoking work place, but still do not enforce the policy, to the detriment of people that do not like to be in an enclosed environment with smokers that can't control their addiction.
My question is. Who can I contact to spot check the co. on this obvious fraudulent policy, to get them to fall in line. Also, when I have brought up getting a nonsmoking policy implimented in the beginning, Oh boy was I the bad guy and it lasted for months. So I would really like to work this out with the people that have the most influence.

What kind of policy are we talking about here? It may or may not be fraud. I think you are going about this the entirely wrong way. Even if you could get the insurance company involved and they see that it isn't a non-smoking environment, they may raise the rates but that doesn't mean your employer will suddenly enforce the policy.

This is fraud no matter how you want to catagorize it. I can no more tell my life insurance co. I'm a nonsmoker to get a better premium and actually be a habitual smoker. At least my character won't let me!
I read your reply, and thank you. But I'm looking for help. Is this a Workmans Compensation Ins. issue? My posting seemed to answer your question. Raise rates or compliance is what needs to be done, preferably compliance. With all due respect, I don't like someone peeing down my back and tell me it's raining. Which is what I feel is happening.
ElleMD, you said I was going about this in the wrong way. Is there a better way? Do I dare ask what you need to know to help me.

I'm asking what kind of insurance because it makes a great deal of difference. I'll give you an example. A school may have a non-smoking policy and their property insurance may reflect this. The fact that there are some who may smoke on the property does not automatically invalidate the policy nor make it fraud. And if you know of a way to 100% keep students from sneaking cigarettes on school property, I'd love to hear it (supergluing their lips together until they reach 21 tends to be frowned upon).

If this is health, life or other capitated policy, I have never seen a policy that treats the employee population as a whole. There are various sorts of policies that give a discount to individuals who do not smoke, or that give a discount if a certain percentage of employees are non-smokers, the employer offers smoking cessation assistance, or a host of other factors. I have never seen a policy globally treat everyone as a non-smoker based solely on the employer having a no smoking policy.
