View Full Version : My Job switches schedules and doesnt allow breaks on the clock West Virginia

Im getting very frustrated with my job. I want to find out if the things they do are legal or not. First off, most employees work a 7 1/2 to a 10 hour shift. we get a 30 min break off the clock. but no on the clock breaks. Another problem is i switched someone for my shift and it was all ok with the manager. So i was goin to take his shift on another day from 6pm to 2am, i comfirmed it with a manager and she said thats when i work. So on the day i have to work that shift i get a call from another manager saying i work 11pm to 7am because they need me, i polietly asked are you telling me or asking me they said telling you. i got into an argument with them telling them that i was told to come in at 6pm to 2am she said the manager that told me that said 11pm to 7am. Note, i am manager trainee.. i told the manager i was on the phone with my life is not only this job she said as a manager it is, i said well im stepping down and hung up. i need some comments on this please :mad:

Federal law does not require any breaks, paid or unpaid.

You get a 30 minute unpaid break and that far exceeds what the feds require.

So far as I can tell, WV does not require breaks, either.

Looks like there may have been a communication problem about when you were to work. Even if there was not, the employer can change the schedule without notice. While the employer does not need to have a reason for this, they don't do that for no reason, but based upon business needs.

Your employer is lucky to learn now that you would be less dedicated to the job than what they see as the ideal manager.

WV law requires a 20 minute unpaid break for every 6 consecutive hours worked. You're getting that, and more. They have no legal obligation under the law to provide any form of rest break or on the clock break.

As Scott says, they are free to change your scheduled hours of work as they find necessary.

Everything you have posted is legal.
