I was wondering if i have a case against a doctor that first of all he misdiagnosed my problem said it was a sprain and strain " as per to workmans compensation thats what they wanted him to say " and not a bulging /herniated disk ,the mri clearly shows a way messed up disk as in bone on bone i have had surgery to repair it the surgen said is was dissenigrated "disk" second the Dr. cussed me out, and then physically assualted me as i was walking out of the office, what recource do i have against the doctor. ?

Well, if he assaulted you, press assault charges.

It is far from clear whether the misdiagnosis is malpractice. Most of the time it is not. Unless the problem with the disk was caused by the accident, it wouldn't be part of the WC claim anyway. If it showed degenerative wear and tear, which is what I think you are tryingto say, that wouldn't be because of the accident.
