:D I am a green novice in the world of Labor Laws, but I do take a heated interest in these matters. Mainly because a lot of these ridiculous laws in Kansas can and do affect me. Many people wait until something happens and then are suprise by the lack of protection over Kansas laborers.

There are some laws that I want implemented(not changed because there are no current laws about them, from what I gather)

I think it is irresponsible for all Kansas workers to walk around and have no protection. No breaks, no lunches, and firing us whenever you want, for whatever you want without documentation or even a simple REASON.

This lack of laws is only HELPING sloppy business owners to run terrible establishments. Now, I know that most of the time people just like to complain and get there own way by seeking out laws, but we are standing around way TOO vulnerable right now.

I can think of countless scenarios where people are overworked, under compensated, and fired with NO POSSIBILITY of legal recourse! And this fact has not yet thrown a red flag in Kansas. Why not?

(extreme example not impossible:)To think that a person could be fired for refusing to work 90 hours is week, randomly, is common place in Kansas. (really, this happened to a friend [in fastfood!!])

Also, (and I am really frustrated by this) if I really respect a Kansas employer and I am thinking about leaving, I put in a two week notice, only to let them know:"hey you're gonna be short one body here soon".(as i hope you do too!) Now, if the boss wants he can fire me on the spot! And it's said that they are "accepting" your notice right then?! I think it would change your LIFE if you knew that someone could not just release you from employment like that. I am freaking scared to put in a two week's notice! But here's the kicker, (and if this is illegal PLEASE let me know b/c it would benefit hundreds of people at my job!) at my job, if you put in your weeks(out of respect for the employer) my boss can "accept" that notice on the spot AND THEN our company will reset your last check to reflect payment of minimum wage for the entire amount of hours you worked!! So, I will go from 80 hours at $9.75 ($780 gross) to 80 hours at $5.15 ($412)!!!

I hope this very simple, but very true scenario will really strike people and help them understand how this is ludicris.

Now, a friend told me another situation he experienced that I'd like to bring to the table about Kansas worker's misunderstanding of their protection. He was fired from a gas station(not the greatest job but whatever). Now he was working about 40 hours already and had been working 12 hours on a Friday and this meant that he was already on OT(overtime) by a couple of hours. A manager came into the store and informed him that he would now be working on the weekend too. Now, this Friday night was 12-23-05, Christmas Eve's eve. This guy had plans(per the schedule posted) to work all week for people to ensure his weekend off. He liked the boss and knew that 2 people had quit, so worked though Christmas Eve and then all Christmas day. Sunday night the boss came in to help close everything down. My friend was counting the drawer and came upon a discrepancy in the money. He notified the boss. After being hopelessly baffled on a Christmas night, the two decided to call it a night and handle the money in the morning before the store opened(at 6am!) The next day the boss called and said after reviewing the tapes from the store's camera, they observed suspicious behavior by him throughout the day. Things like leaning back, sitting down and rubbing his eyes. (*he was going on 70+ hours at a gas station) The boss asked him if was drinking. He said no. And the boss had found a liquor bottle outside in a trash. He WAS fired!! No further explaination. Then, was taken down to $5.15 pay. That was it. No explaination because KS law never required it. And by the way the next day on that monday a lady came back to the store to say that she had driven off on christmas and didn't pay for her gas. that amount was exactly the difference in the drawer!!

Anyways, gotta go.
I will check back for replies but I just really want to start to make a change here and my mom says I can do whatever i want. I just started to believe her, ya know!?

Your state is by no means the only one where such circumstances exist. But if you want to see some protective laws implemented, the place to start is not venting on a message board but by lobbying your elected representatives.
