HI, I had a quick question. I wait tables at an up scale steak house in TX. About a year ago I started to date a manager there. He had decided to stop mananging before hand. 6 months later he and I are both servers, and he wont leave me alone. It has now been 5 to 6 months since the realationship eneded and he is making work unbearable. Glares, snide comments, and pushing me around. Another server approached our manager and told him what was going on and that he should talk to me. A few weeks later I approached the manager told him I was coming to him as a last resort. He said he would speak to the employee, and then the very next night after he did, he threaten my job. Saying that the other employee said he did nothing wrong. I asked if he ( the manager ) was even going to ask around, and he told me it was my fault for dating a co worker. If we didnt start getting along he would fire us both. Well the employee has continued this and infront of many people. Is there anything I can do?

Can you give us some examples of the comments and what you mean by "pushing you around"?

In restraunts you have tight fitting hallways and have to walk around eachother in between tables. He will barge pass me with out moving over, and it will knock me into to walls or tables. He will also not let me know when he is behind me. LIke if your are at the dish pit, waiting to set down dishes, you will let the person infornt of you know that you are behind them so you do back into them. He wont say behind you. I was trying to pass with food in my hands the other day....you round corners by saying "hot food behind" he made a move to the left side of the hall way so I went to the right and he stuck his feet out. I hit the wall. As far as the comments, he will walk by and call me names....or when I am walking by a group of people talking with him, he will loudly proclaim what a B***** I am.

File a claim with the EEOC - sounds like a hostile work environment.

Actually, it doesn't sound like the legal definition of a hostile environment. It sounds like an unpleasant one, but one based on interpersonal difficulties between you and not the fact that you are female. I certainly don't condone his behavior but he is not in a position of authority over you and the law does not require that he be nice to you.

I would report it to whomever is the manager as this isn't the sort of behavior that they should be tolerating but it isn't the definition of sexual harassment either.
