View Full Version : Do I have a Medical Malpratice Case? Pennsylvania

This could be a very long story but I will try to make it short. In 1992, I was diagnosed with Cancer. Between 1992 to the current day, I have had 5 primaries and a couple major operations due to the cancer. I have also had a stem-cell-transplant.

In May 2006, via an invasive biopsy, I was diagnosed with BOOP pneumonia (Bronchiolitis obliterans organizing pneumonia). Within the past 3 weeks, I needed to have a bronchoscopy. My health dictates that this procedure MUST be done in an "O-R" and I MUST be put totally under like any other major surgery. About a week later, I found out the Hospital Lab contaminated the cultures and the cultures had to be sent out for special processing. Three weeks later I still do not have the results.

This has caused me a lot of worriment and tension. Do a have a recourse here? I spoke "off the record" to a local attorney and he said "I do not have a case unless it causes irrevocable harm". I am not buying what he says.
