Hi,
I am a little confused about whether my previous job should have had me exempt or not.
I was salaried and worked over 8 hours almost every day. I also did work on the weekends and had to occasionally do work off hours (starting at 11pm).
I was an IT Generalist - software, hardware, user support, server support. Basically a Jack of all trades. I also had to be available all hours - nights, weekends and vacations.
I would work over 80 hours in a 2 week period, but if I was out one day they would use my PTO. I couldn't figure out from the other posts if PTO falls under sick time or personal accrued time. We received no sick days or personal days, only PTO and holiday.
This company also gave me a lot of trouble with my maternity disability as they didn't respond to the initial request from disability which delayed my claim until I went back to work.
They also utilized my maternity leave as a "test period" to eliminate my position which they did 3 1/2 months after returning from maternity leave.
I am wondering if I fall under the non-exempt definition.
