I kid ibn our town here was fired the other day in a strange way. He got hurt on the job site, sent to the doctor to get treatment, where they also did a drug test, common practise for this Company. He went back to work the next day. He gets told on Friday that he is fired because he failed drug test, when he inquired at the head office what drug was it, they told him they didn't have to tell him. He swears up & down that he took nothing, except what they gave him at the hospital. Is this legal besides unfair??

I work with drug collection clinics, and he has a great case. The first mistake is that the Medical Review Officer needs to contact the donor first to clear any drugs prescribed that might show up. Second, all he has to do is ask them to have the split specimen tested. A good drug testing programs requires a split specimen.
