As an employer am I legally obligated to continue ones health insurance while they are on workers comp? This employee has not contacted me to let me know a return to work date or update about the injury(which i question if it happened on my job/time)

12 employees so i do not think fmla applies!

No you are not obligated to offer FMLA or any leave for that matter. You need not continue paying the insurance either, however, I would treat this person exactly as you would for any other non-WC absence.
