My boss last week threatened that I will soon be working weekends. I am considered an exempt employee from what I know (paid salary) and easily work over 40 hours per week M-F.

MY QUESTION IS.....Does the employer here in California HAVE TO give you a comp day if you're working the 40-hr+ M-F shift and also forced to give up part of the weekend?

Any help on this is appreciated. Also, can a company fire you if you say you're not available on a weekend. I was hired with the understanding I would work only weekdays and rarely a weekend. I've maybe worked 3 weekends in 7 years.

YES! Employees are subject to the scheduling demand of their employers and if you are called-in to work part of a week-end and refuse, you can be fired.

As to whether or not you are entitled to overtime premium pay (e.g., time-and-a-half) for working more tha 40 hours per week, this depends on the type of work you are doing. If you are properly classified as a salaries "exempt" person, no overtime pay is required.

I was hired with the understanding I would work only weekdays and rarely a weekend. I've maybe worked 3 weekends in 7 years. Then you've been very fortunate but apparently things have changed. A statement when you were hired that you would rarely work weekends was (a) clearly true, and (b) not binding. If they now need you to work some weekends, then you work some weekends.
