a FRIEND OF MINE JUST RECENTLY TOOK A JOB DRIVING A DUMP TRUCK. Upon being hired the employer told him he didn't pay overtime, but would be expected to work anywhere from 40 to 60 hour a week. Can he get away with this?

Not really, and that's assumming that as a truck driver all driving is done withing the state. And as a truck driver your are not otherwise exempt under federal labor laws.

No. Again, assuming your friend drives the dump truck in-State, he must be paid for his overtime. The first time your friend isn't paid OT for any hours he works over 40 in a week, he may file a complaint with his State's Department of Labor.
