my employer and I had a falling out on last tuesday, words were said and I left the office w/ all my belongings, basically I quit

now my employer is telling that I must come in and sign a resignation letter before I get my last paycheck. they are refusing to give it to me otherwise.

can they do that.

No, he can't hold your paycheck hostage.

However, he has not violated the law until the next regular payday has passed, as he has that long to mail your final check when you quit.

well that paycheck should have been given to me on last Friday because it was for the week before. Monday I was out sick and Tues I was there for all of an hour before I left, I don't even know if they plan on paying for that hour and a half I was there and I don't care, I just want my paycheck for the week before.

should I let them know that they have to mail it to me

By all means contact them, and if they don't comply, feel free to contact the TWC.

Just out of curiousity, why such an objection to signing a resignation letter? By your own admission, you DID resign.

When would you have been paid for your last period of work had you NOT resigned?

to answer your questions

had I not left that day my check for the last pay period I was there should have been this Friday coming up but like I said it is only for about an hour and a half.

as for the resignation letter, one- I have no desire to go up there and see those people

and two- I don't trust them I don't want to sign anything I am unsure of.

Well, you aren't going to know if it's something you're "unsure of" unless you actually see the document.

Why don't you just write up your own resignation letter "I hereby resign from XX company effective DATE." Period. Take it to them and say "here's your resignation letter; please give me my paycheck."
