I was forced to take 8 hours PTO for Saturday after working 44 hours Monday-Friday. They made me take the pto because I'm unable to work the Friday of the following week after Thanksgiving and this way they said they would pay me holiday pay-otherwise they wouldn't. Can they make you take pto after already working 40 hours in a week?

They don't have to pay you holiday pay at all. Although I think it makes no sense to make you use PTO for a day that you weren't scheduled to work anyway (Saturday), there is no law that precludes them from doing so. It has nothing to do with the fact that you had already worked more than 40 hours in the workweek.

Pattymd: It sounds like company policy may void holiday pay if the worker calls off for a shift prior/following the scheduled holiday. I believe the boss is asking her to use a PTO day so that she'd be eligible for holiday pay under company policy. My company has this policy for non-exempt workers. We do this to reduce the risk of mass calls out for the day prior/post the holiday.

Boy, I never would have thought of that. See how trusting I am? :p
