View Full Version : Not paid and angry Michigan

:mad: I was hired as a contractor by a local company to work on a contract for a major pharmacy. I worked for 3 weeks and at that time I asked about a pay check and was told it may be 3 - 4 weeks because of difficulties collecting from there contract. I told them I was not comfortable with that and I would not do anymore work until I had been paid something. That was 8 weeks ago. It is now 11 weeks since I started with them, I have received no money and all I get is excuses about there problems collecting.

I have a couple of questions.

1. Am I really a contractor when this company supplied 100% of my work?

2. What can I do to collect my money fast? Christmas is coming and because of this I have nothing except what I was able to borrow from my parents and they have reached there maximum.

Somebody please help me.

It's possible for an "independent contractor" to only do work for one company. This is quite common in certain industries. As an "independent contractor", labor laws do not apply. Your recourse to collect monies is (1) discuss arrangements with your client OR (2) file a civil complaint. If the latter option is explored and the amount due is small enough, small claims court would be your starting point.

Based on the verbal arrangement I am owed 2500.00 dollars. Since then I have written proof of this ( I emailed them an accounting of debt and they did not dispute the amount in there reply). What is the cut off limit for small claims crt.

It's my understanding that the max in Michigan is $3,000.

Thanks for the link I'll look at it. I wish there was sometning else I could do though. No way to get a small claim through in time to buy my wife a christmas present.

I'm not certain on the timeliness of a hearing. But I doubt such a "speedy" turnaround (hearing + judgement + receipt of money).
