View Full Version : Hopefully Final Questions on Overtime/Holiday Pay Ohio

Scott,

I referred back to the employee manual. I couldn't find the part about paying time and a half for the holiday, I swear it was in there but it may have been something that was told to me verbally upon being hired or from other employees here longer than myself. The only reference to holidays is that an employee may not take vacation over a holiday week or request off the holidays designated by the company (Easter, Chrismtas, Thanksgiving, New Years Day, etc.).

There also isn't anything about overtime pay in there. Its just a very small employee handbook that just covers the basics about tardiness, paydays, lunch periods and breaks, etc. I did worked the Labor Day holiday and did get paid time and a half for it but my total hours for that week were only 40 not 48 as in this case.

I'm sorry to be a pain but before I approach the boss(es) regarding this I wanted to be clear if there were any legal laws or policies etc. so I can be prepared and not look like a dummy. I tried the government websites but good grief they are hard to understand and find stuff on so I decided to take this approach.

Again any help is appreciated.

I'm not Scott, and I don't remember your original post (we read hundreds of posts per day), but I CAN tell you that, if you work for a private employer (not a government entity), there are no laws that require that you be provided with paid holidays or that you must receive premium pay for working on a holiday (in your state).

As I have said before, and as Patty stated above, there are no laws that require the employer to pay you anything extra for working on a holiday. When you work 48 hours next week, you will be paid at least 40 straight and 8 overtime. You MAY get 32 straight, 8 OT and 8 at time and a half for working on the holiday, but that is totally up to the company.

It makes sense to pay like that, but there is no legal requirement. Even if it is company policy, those can change in an instant.
