View Full Version : not allowed to return to work after maternity leave

i went on maternity leave a week before my daughter was born and i was told by both the owner of my company and the general manager that i could come back whenever i was ready and i would always have a job with the company. when i told them i was ready to come back they told me there was no longer a job for me...they filled it!!! are they allowed to do this? arent i legally entitled to get my job back? i was only gone 6 weeks....:confused:

How long had you worked for that employer before you went on maternity leave?

How many employees does your employer have within 75 miles of your location?

In the 12 months immediately preceding your leave, had you worked at least 1,250 hours?

What state are you in?

i worked there for 15 months
there are 17 employees in this company
i was a full time employee working 30-50 hours a week

i worked up until i had my baby, 9 months pregnant, on my feet for 8+ hours aday

im in ohio

Sorry, but your employer is too small to be required to offer FMLA, and Ohio has no state equivalent. That being the case, no, they are not legally required to hold your job.

The ONLY exception would be if you could point to a similarly situated employee who took six weeks off for a non-maternity condition and who was returned to work.
