Our company has recently filed for bankruptcy, and made several changes to the system. I am a supervisor (salary non exempt) getting paid overtime for any extra hours that I work. Starting today now all of a sudden we are exempt employees and were not compensated in our hourly calculations, is this legal?? Or can someone direct me as to where it says that is is legal? The answer that I get is that the law states that you don't have to be paid overtime, which is fine but when I accepted the position I was told I would get it and now don't!!!:mad:

Whether or not you are exempt is based on the exemptions in the Fair Labor Standards Act: http://www.dol.gov/esa/regs/fedreg/proposed/2003033101.htm

If you are legitimately classified as exempt, then what your employer has done is to give you a cut in pay for the same number of hours worked.
