I am a single mother, who is currently still in the process of trying to find a father, paternally; so there is not a present father at this time. Having these facts, I tried to put into my will, that i wanted my mother, if i passed to take on the custody. The lawyer told me that it was not possible to do that and all that could be done was to suggest the fact. He also said that it was up to the courts to decide what would happen to him. :(

I am now doing a paper on the subject and cannot find any law(s) that state that... I have found, however, a law that states that grandparents have to go through a process to make sure that they are capable, of the task, but not that they cannot take care of the child.

my question... what law(s) states for or against the grandparent getting custody of the child, as in my case.

I only have 2 weeks to finish the paper!!! Please help!!!

Thanks for all who reply to this!!

That got me laughing... I tell my son all the time: "Your teacher didn't assign ME homework!"

Cause I am informative, yet infuriating.... it is part of my immense charm.

I'm with the others on this one. I actually know the correct answer, but I am not about to do your homework for you. I've got my own kids' homework to help with.

I agree with the others, you'll need to do your own research and homework. However, there is one thing I will point out, that is that there is a HUGE difference between Grandparents (or anyone else) gaining custody by going to court, and a child being "willed" to someone in a will.

Better, I will trade you a full agricultural and economic report on Taiwan for it.

Or a senior research paper comparing the nonconformists in Kafka's "The Metamorphosis" (in German, nach) and Aldous Huxley's "A Brave New World".

yeah, that was a fun and LONG research paper.

Thank GOD for the internet.

Or had to nix the experiment for the science fair that involves testing ACIDS, ALKALINES, and BASES to see which substance causes the most and the least corrosive properties to various surfaces. Oh yeah...had that convo today. The least dangerous acid was carbolic acid. Now, can you see me walking into my local Lowes and asking for the most corrosive substances they have? I just KNOW that my 4 year old terror would blow up the house.

We settled on testing salt water vs. fresh water to see which produces more rust. Oh joy..... There goes my patio furniture...

Actually, we did that experiment for the science fair last year... if you want, I can give you the name of the on line place that sent me the stuff.

by the way, I recommend highly AGAINST accidentally mixing sulfuric and hydrochloric acid and then pouring them over aluminum. Somewhere in my yard, a melted test tube is trying to get to China.

Why yes, you can also get non corrosive aprons, gloves and goggles there too... why do you ask?

Nah... I figure that somewhere in Shanghai a kid there is doing the same experiment so it will end up a net net.

you know what... im done with the paper; i had done it in a broad sense. I was really wanting to see for my own knowledge. You can turn in papers early. I am sorry to see that this is a blog for information and knowledge, but most seem to be lacking in that department.

thanks though.... ;)

Ohhh... so unless we do your work for you we are worthless people?

Great... let me guess, you are getting into law to help people, right... not to make a fortune?

actually, the field that i am going into doesnt make much money.... sry to disappoint you... and i didnt state that you are worthless... you must have a guilty conscious. I was merely stating that this is a site to talk and help each other, not to try to make yourself feel bigger.

sry. ;)

This is a site to give general legal information to people that need answers for a situation they are dealing with. This is not a site (and most definetly is not a blog) for students to do "research" for a class assignment.

For that, I suggest you hit the library. You know, that place that has all those interesting things called books. For your question, you should probably have gone to a law library.
