My grandparents have vistation of my now 12 year old daughter.

They tried on 2 occasions to get custody from me and failed.

The first time they were granted partial custody for visitation every other weekend.

The second time the partial custody was taken from them and the court order now states "visitation rights from Sat 10 am to Sunday 5 pm on the secong weekend of each month"

We want to stop the visitation. It is a long twisted bizarre story but it is truly awful for my child to go there as they continuously try to fill her head with garbage that I don't love her and blah, blah, blah...

Is there an age in PA that a child can refuse visitation?

The attorney I had to help me did everything pro bono and I just want to know what I can do before I bother him again.

she is of age to have her opinion considered and count in court.

So what your saying is that once a child is 12 they can go to court and a judge will consider what they want?

yes. The judge takes the childs wants into consideration at this age. However that doesn't mean that whatever the child says the child gets.

I know she is old enough to speak about what she would like. They listened to her when all this first started and she was 9. What I'd like to know is if there is a designated age that she can actually refuse the visitation.

You might be confusing a refusal to visit with a modification of visitation order.

Basically, as long as there is a court order for visitation it has to be followed. At no time or age is a child allowed to refuse to visit when an order exists.

Modification of a visitation order is different, usually a Judge will allow a child of 12, 13 on up to state thier wishes, but it's still up to the Judge as to what to do.
