View Full Version : Is the 4th month of PDL covered by STD? California

I'm just completed 8th month and already took 12 weeks PDL/STD (months 2-4). My STD plan say max. benefit is 12 weeks. Now after 8.5 months my doctor puts me on medical leave to deliver.

1. My company says I'm still entitled to 1 month PDL + 3 months CFRA, but unpaid, maybe Long Term Disability.
2. I think I'm entitled to 1 month PDL + 3 months CFRA, but in parallel to ~12 week STD again (supported by doctor, c-section) running concurrently on top of CA SDI.

I quote my STD plan: "Short term disability is available to all full-time and part-time regular employees who have been employed continuously by the firm in that eligible group for at least 90 days". I did work precisely
92 days after my last medical leave (PDL/STD) of 12 weeks.

Who's right my company or me?
My employer has >100 employees in CA. I've been working for over 2 years continuously until my last medical leave of 12 weeks.

Well, the state SDI would cover you up to 6 months (if you were disabled for that long) but I can't speak to what your private plan covers.

I understand that you can't speak to a private plan, but who can if the plan description which I gave above is ambiguous?

How can the company's STD plan say the max. benefit is 12 weeks and not explicitly specify when these 12 weeks can be taken again (in 90 days, in a year, never)? Are there standards/rules an insurance plan description must comply with? I believe the former CA insurance commissioner Garamendi was writing about it.
