ok here is the skinny on 100% commision sales for an inside sales person. this information was given to me by our payroll department manager. pay rate for sales people must be (min. wage x 1.5) x (hours worked) in my case (6.95 x 1.5) x (43.5)=453.27 per week. my draw is currently 375.00 per week. so am i to assume that if i dont make my draw each month that i can't go in the hole because my draw is less than the minimum i should be paid....and will i get pay above and beyond my draw to make up for the difference? also yesterday i asked my boss to bump my draw to 450.00 per week because i was signing papers to buy a new house and this would help me through the winter. his response to me was " you may not want to sign those papers until you talk to me on wednesday" my heart almost jumped out of my chest...what am i supposed to think about a response like that?

Not necessarily. What the payroll manager gave you was what you must make in order to be excluded from the overtime provisions of the FLSA. If your pay goes below the amount she calculated for you, you must be paid overtime. A representative period of at least a month is what is recommended by the FLSA. This has nothing to do with your draw.

And as regards to your request for an increase in your draw, we have no idea what is in your bosses head.
