Just Curious... My wife has worked for a nursing home for ten years without incident and recently she had a nurses aid that just refuses to do their job. She wrote him up as much as many as 4 times and reported the problems each time to her supervisor and the Director of nursing.
Well long story short, She was called in to the discussion that her supervisor and D.O.N. were having with the very same aid over the fact that he just picked-up a resident off the floor "which i undertstand is a crime in itself" and his nurse, my wife just wrote him up a again. Once she got in front of the troubled Aid he began to tell them what kind of a liar she was and yes he did pick her up but whats he supposed to do and how she doesn't give him a chance to get his job done and How she isn't his MAMMA and she can keep her orders to her self... and at one point during the conversation if you could call him YELLING at her a conversation she became so frustated she said "Thank F@cking god i'm not your mamma" that one line got her suspended for 24hours of work and his first displine!!
Now i know the "F" bomb is inapropriate but a suspension, after he's been written up numerous times and nothing?? He takes the law in to his own hands and she has to justify her existence??? to the point where the frustration of even dealing with this man causes her to defend herself, and she's suspended?
After the incident the man obviously called his family who in turn began calling at work and telling my wife how she cursed at her baby, their brother... Who by the way is 35years old.

Sooooo can anyone tell me if this even sounds NORMAL??? How long does a liscensed employee allow a certified worker to put their job and liscence on the line with out any form of defense? Or should she just keep her mouth shut and take the contiued abuse untill she finds another job, which is what she is doing!!!

First off, this is not a hostile work environment. That phrase has a very specific meaning under the law and this does not meet it.

As a supervisor, your wife can be held to a higher standard than other employees. It was legal for her to be suspended even if they did not take the same action for the other employee.

I'm not seeing any illegal activity here. Unfair, possibly. Illegal, no.

If her counseling this employee wasn't doing the job then she needed to take it up the chain. Perhaps look into a suspension for him. Yelling back using profanity is completely out of line and yes, she could be suspended for it. He didn't make her do it. Her frustration may be understandable but her actions were extremely unprofessional.

I'm not sure why she would even take a phone call from his family members. If they call, she should just state that she is not going to discuss the matter with them and end the call. No need to get nasty and no need to listen to them gripe either.
