I work in a manufacturing facility (13 yrs) and was recently "demoted" for perfomance reasons. Our company has progressive disciplinary actions that are sometimes followed and sometimes not (my case was not). My questions is, can I receive a demotion based on disciplinary actions not followed and well known systemic issues that prevented success in my position? NOTE: I was "demoted" to a position that will utilize 90% of the reason why I was demoted in the first place!:(

The quick answer is yes, the company can demote you and it does not have to follow policy.

Should you quit, you might be able to convince the hearings officer for your unemployment claim that you quit for good cause attributable to your employment. Might.

Can the company request me to continue to do the job one more day due to my replacement being in orientation and no one else is qualified to do my job or can I legally refuse to do this due to being demoted?

Legally refuse? No. You refuse, they can fire you.

Sucks, doesn't it? You do the old job for the lower pay.

Legal.

Sheesh, if I hang out on this board much longer, I might consider switching my party affiliation.:(

Totally sucks due to the fact that ANY company can treat their employees like that (NO DIGNITY FOR US LOWER ON THE TOTEM POLE) and let managers get away with blatant issues that create a hostile enviroment!:mad:

I am an employer. I have had folks cuss me out. I have folks sing high praises.

I have only once demonted an employee (usually better to fire them) and would never, ever have thought about asking that one to perform the job from which I demoted him. If I did, I would have paid the rate for the job being performed, but that is me, and not something required by law.

If your employer does not like you, it does not mean you are in what is called, under law, a hostile working enviornment. It simply means the boss or supervisor does not like you and will make your life miserable. That is not (or not yet) illegal.

Find a new job. You and the employer will be better off.

A "hostile work environment" has a very specific meaning under the law. What you describe does not come remotely close to meeting it. Sorry.

We are treading on hostile work environment when the managing director is hiring and promoting from within the same sexual orientation as they are! Dusting off the resume!

Sexual orientation is not a protected characteristic in Michigan. (And you never mentioned that point before)
