View Full Version : Ohio carrier holds drivers final pay.

I recently left a Trucking Company for various reasons. Now they sent me a letter stating that they are holding my final pay untill they can audit all logs submitted and are corrected. can they keep this money???

The short answer is "no".

I'm curious as to how your time is calculated. Are they based on these logs that you mention? If yes, then the employer does have a supportable reason to "temporarily" hold your pay until it's able to confirm your "correct" wages. Generally this is allowed for final bonuses and commissions. If my assumption is correct on how your time is calculated, I'm confident that the same defense can be made here.

I'm not saying that it's "ok" to hold your pay. But I believe it's fair to make sure your final check is "correct". Hopefully this will not take too much time.

It's my understanding that if you wish to pursue an unpaid wage claim, you'd do it via filing a civil complaint in court. If the "hold" is excessive, then this would be your next step.

And what is also unfortunate for the OP is that Ohio law has no provision regarding when terminated employees must receive their final paycheck.

OP, how long do they say it's going to take? And how long ago did you leave?

I have benn gone three weeks now and I have corrected 5 logs sheets and every time they tell me I will get it they find another reason not to release it.
Also of the three that have left there in the last 2 months none of us have yet to receive our pay.

My pay was 26% of the load my logs were only for DOT reg.

3 weeks is a little too long. 2 months is WAY too long. Contact the federal Dept. of Labor and see if a call from them might shake your check loose.
