I am currently 35 weeks pregnant with a respective due date of December 5th. This was an unplanned pregnancy, I had only been with my company about 5 months when I found out that I was expecting. I was officially hired on with my company December 12, 2005. I was told that my position will not be secured under FMLA if I deliver before December 12, 2006 due to the requirement of one-year of continuous employment prior to taking any FML time. However, I have two weeks of vacation time that I could use should I deliver before my one year anniversary. If I opt to use my vacation time prior to my one year anniversary, will my position be secured my FMLA?

All other things being equal, as long as yoiu've worked the requisite hours, once you hit your 1-year anniversary date, you're eligible, whether you are currently on leave or not.

BTW, FMLA is, by its nature, unpaid time. I take it you're trying to use your vacation to get you to your 1-year anniversary, right?

Yes, I am planning to use it simply for that purpose. I do know that the FML time is unpaid.

You may only use the vacation for that purpose if your employer allows you to do so. They very well might, but aren't obligated to.
