My wife works for a small company approx 10 here in Colorado. She hasnt decided whether she will return to work after the baby arrives. If she decides not to return to work shortly after the baby is born, are we obligated to pay the health isurance premiums (or the medical bills for that matter) for the time that she did take off. If so how long would she have to return to work after the birth to not have to pay the premiums?

Since FMLA does not apply, she can be required to pay back the full premium at any time. FMLA considers 30 days as having "returned to work". As that is not applicable, it is up to the employer. They may not even require the premiums be paid back at all. You will have to ask.
