Hello all,
I have a couple of questions which I hope you can help me with.
I am currently working for an employer in California who claims to be "backed up" on orders. The employer decided to make working "every" Saturday mandatory (after working Monday through Friday). At first they said that the mandatory Saturdays would stop at the end of July 2006 then they moved it to the end of September 2006. Now they are saying it will be the end of December.
They state that anyone who does not come in on Saturdays will have a deviation which leads to no raises on an employee’s next review or could also lead to termination. Is this legal?
My second question is about the way they have their "shift work" scheduled.
Day shift: 6:00 a.m. to 2:30 p.m.
Swing shift: 2:00 p.m. to 10:30 p.m.
Graveyard shift: 10:00 p.m. to 6:30 a.m.
The graveyard shift is the starting shift for the week so people on this shift start on Sunday night at 10:00 p.m. This is considered the graveyards shift "Monday". Now the problem is, if the Sunday is a holiday they don't consider that as "Holiday pay". It would be logical to say that for 2 hours (10:00 p.m. to 12:00 a.m.) you are working on a holiday. But they say they do not have to pay "holiday pay" for such occurrences. What are your thoughts on this?
