My question is the following:
Can the state of NY modify a child support termination court order from another state?
If so here is my situation. In the state where I reside, child support ends at 18. So with this said, once my ex recieved the termination order she wants to take me to court in NY to continue recieving child support. In NY 21 is the termination age. My son ran away from her house and was out for 10 months. Now he is 19 years old and came back to reside with his mom. Shouldn't he be emancipated once he turned 18 and was gone from the house for that time? Oh by the way the only reason he went back with his mom was because she picked him up at the correction facility. I dont know whats going to happen, please what can happen? Do you guys think the judge will dismiss this motion just because there is another court order in place?

No. A state (in your case, NY) can modify an existing order from another state (if all conditions are met), but it will be modified according to the issuing state's guidelines. Also, a state cannot interfere with a child support order if one of the parents is still living in the issuing state. There are specific laws in place to prevent a parent who is recieving child support from doing this.

So, if your order states that child support ends at age 18, it ends. NY cannot extend the time you must pay child support.
