I'm a salaried employee and I'm a funeral director. My employer doesn't allow me to leave a 25 min driving radius of my home 6 days a week. I'm on call from 4:30pm-8am EVERYDAY, but one day a week. I work from 8am-4:30pm. I understand that there is a fairly new law here in Michigan in reguards to overtime and I'm a new resident here. Please tell me is the law being broken? I'm only paid for 40 hours a week. Because of this schedule that my employer has me on only allows me to have 4 days a month of which has been taken away, due to limited staff....so there are some weeks when I work 7 days a week and I'm still only paid for 40 hours reguardless.

Please help I'm new in my profession and I'm already on burn out!

I believe funeral directors are exempt from the overtime provisions of the FLSA and, as an exempt employee, you have no legal expectation of additional compensation over and above your regular weekly salary, no matter how many or how few hours you work. Most likely, it would be under the Professional exemption classification:

If someone doesn't have the cite for this, you can call the U.S. DOL at (866)4-USWAGE to confirm.
