i am trying to help a very passive person here so any information is needed desperately to pass on to him.

a father of a 7 year old boy wants to gain some sort of custody or custodial status in his son's life. the parents of the boy broke up immediately after he was born. the father's name is on the birth certificate. he has been paying the mother every month an agreed upon amount and he has been seeing the son 2 days a week for the past 7 years and by all means is a wonderful father. the courts were never involved in anything.

2 years ago the mother got a new boyfriend who has somehow turned her life around for the worse. he is an unemployed low life and she has been following in his footsteps. to make a long story short, the boyfriend stays home all day and doesn't work and he takes care of the 7 year old boy before and after school. the boyfriend has actually presented himself at the boys school as the boys father and has proceeded to be the sole discipliner to the boy concerning everything. the stupid mother has allowed this to happen. the boyfrriend makes terrible choices and he needs to be stopped somehow.

so the father wants to have the power to say to the mother and boyfriend that he needs to be consulted before any major decisions are made primarily at school and medically and as far as severe punishment goes. (the boyfriend punishes the boy for no reason whatsoever and it is traumatic to the boy who is a very well behaved child being abused by this buffoon) we were deeply disturbed by some of the things the boyfriend has said to the boy. and by the fact that he tells people the boy is his son, in front of the boy, and has actually made the school believe it until the father called to correct him.

the father is afraid and discouraged because he has absolutley no money for a lawyer.

can he do this without spending money on a lawyer? how?

He can try to get a pro bono lawyer. He can also start calling lawyers to see if any would accept payments. But I would not try to do anything without a lawyer.

He can look for a pro-bono attorney, or he can file without one. He can find the forms on line or ask the court clerk's office for them. He'll need to file to legally establish paternity, custody, visitation and CS. In some states the child support enforcement agency will assist a father in filing for the paternity/CS but not the custdoy/visitation.
